Please read these Privacy Policy carefully before using Live Assured Limited website for the "service" we offer.

Privacy Policy

The purpose of this Privacy Policy is to let you know what kinds of information we may gather about you, how we may use that information, whether we share that information, and the choices you have regarding our use of that information.

We process personal information for certain legitimate business purposes which includes some or all of the following: Live Assured Limited is neither a Farming concern, Producer, Manufacturer or an Insurance Company at this time, we only leverage on Agricultural produce and other companies products including Insurance Companies. So do not propagate Live Assured Limited as an Agricultural Produce, Manufacturing or Insurance Company in your promotions. If you do, Live Assured Limited will suspend you from the system.

To be able to participate on our site, you will need to provide us with the following registration information:

  • Genuine and complete name and address information which is required to ensure your account is genuine and to help prevent fraud.
  • A valid email which will only be used should we need to contact you to update you on the status of your account and to provide useful information on the operation of your account or should we need to contact you directly in relation to an enquiry on your account.
  • A username and a password to allow you to log in and operate your account securely.
  • Details of the payment account you wish to use for withdrawals (eg. Bank account information) to be able us send payment to you when requested).
  • Valid Telephone number to help prevent fraud and for account enquiries.

This security information is used in conjunction with the registration information to complete secondary security checks to ensure we have been provided with genuine information, to make sure you are not breaking any rules or terms of our site and fraud prevention. Examples would be registering with false information, or committing fraud.

Additional verification information may be requested in some situations in relation to your participation and activities on our site(s).

We store your personal data as securely as we can on secured servers; and we take all reasonable necessary steps to ensure your data is adequately protected and processed in line with this privacy notice.

We do not pass your personal data to third parties, unless you specifically ask us to for a particular purpose, or we have reason to do so as part of an investigation, or as required by law.

In instances where we suspect there may be a breach of rules, then as part of our investigation we may share the information we collect with regulatory authorities, relevant bodies and in exceptional circumstances, relevant third parties, in order to protect the site and it's members from potential fraudulent activity.

We do not send junk mails (or spam). We send occasional site updates by email and promotional mails as well as related emails of value to our members and the company.

Information Requests

Users may raise a support ticket to request to see any information that we hold. This may include transaction information, account totals, contact details and other information we hold as indicated in our privacy policy. Users will receive the requested information within 14 days of the request.

Delete Requests

Users of our site can raise a support ticket to request that details of their account and any related information we hold to be removed permanently from our site. Any valid requests will be dealt with within 7 working days, and all details will be permanently removed.

Where possible, accounts will be deleted permanently. Where there has been actual activity on your account, for example you have received a payment from us, or participated in offers, then we will mark your account deleted and cease any further communication, however necessary information relating to your account and activity would be retained for as long as necessary on our system.

Where there has been evidence of a breach of our terms (including the business rules and guidelines), potential fraudulent activity or any similar offenses then we would be unable to process a delete request at that time. The information will be held indefinitely, or until such a time that we are satisfied that there has been no breach of rules, fraudulent activity or further threat to our site. In instances where instant deletion cannot be processed immediately, users can resubmit a request to delete their account every 30 days for review. To resubmit your deletion request, send an email to support team. In circumstances where excessive requests are received, a permanent block on requests may be implemented.

Conditions of Sale and Payment Terms:

  • Must be at least eighteen (18) years of age or the applicable state age of majority to have or manage a minor's account.
  • Must be a natural person (or a corporation entity with a valid phone number, email and other required information).
  • All sales of products and services are final. All charges in respect of those sales are non-refundable.
  • we shall be entitled to process your data in accordance with the terms of our Privacy Policy. For some transactions made at liveassuredgroup.com, we might ask for some documents relating to your transaction if the need arises.

BUSINESS TERMS AND CONDITIONS

Business Conditions:

  • Earning on liveassuredgroup.com is not guaranteed, but based on the collective efforts and sales/purchase activities in a member's business team.
  • All incomes are earned, due, withdrawable and the company obligated to pay only upon satisfying the required conditions as stipulated by the company policy, not earlier in all circumstances.
  • Every financial member is required to pay their registration fee (depending on the membership category they choose), and also buy any Insurance Policy (Product) of their choice or buy food stuff for a minimum of N1, 250 to complete their membership.
  • Members are allowed to have multiple accounts (or manage accounts for minors who are their wards or relatives).
  • The BVPs breakdown for new members shall be as follows:
    • Bronze - 20BVPs
    • Silver: 40BVPs
    • Gold - 80BVPs
    • Platinum: 160BVPs
    • Rhodium - 320BVPs
  • Please take note that the BVPs shall be awarded on only registrations.
  • And the BVP earnings is only due and withdrawable upon a member accumulating the amount of BVPs required not earlier and in all circumstances.
  • Every member must renew their policies and meet their N6,250 requirement monthly, and if they have a 3 months past due premium and or food purchase requirements, then their account will be suspended until they can clear their outstanding(s).
  • A member is at liberty, if they already have a running Insurance (which will be moved to Live Assured Limited at expiration), to buy food stuff for the minimum expected premium amount of ₦1,250.00 as required monthly.
  • All incentives shall be withdrawable in cash (to a member's regular bank account) without any hindrances if all conditions are met.
  • Withdrawal limit is ₦5,000.00 and transfer charges will be borne by the member.
  • Dispatch Companies and Stockists will be responsible for items bought and to be delivered to any member by the dispatch or drivers. Hence they will have to recommend dispatch riders or drivers after doing their due diligence and extended due diligence.

Please note that the Privacy Policy of Live Assured limited is subject to change by the Management of the company as situations and realities require.

Goods Return/Refund

  • Unsatisfactory or bad goods meant to be returned must be done same day; however, a prior notification by Phone or email must be received by the vendor within two (2) hours of receipt of the goods (at no extra cost to the customer; who is expected to contact the company through 0913 000 0450 ).
  • The return cost will be borne by the vendor as a deterrent to the vendor.

Refunds of payments made for such goods will be done within 24 hours.

Chargeback/Refund

We are committed to resolving chargebacks/ refunds confirmed and reported to us within 24 hours. However, if there is a failed transaction on our Platform, where we do not get value yet the customer/User has been debited;

  • Then, the customer is encouraged to wait 24 hours for confirmations or auto-reversals.
  • If the value is still not received and confirmed by us.
  • Then they are encouraged to report to their banks for resolution.

Risk of Regulatory Actions in One or More Jurisdictions

You represent that you understand that the Services may be impacted by one or more regulatory inquiries or regulatory action, which could impede or limit our ability to continue to develop or offer some or all of the Services in your jurisdiction, or which could impede or limit your ability to access or use the Services/ website(s), and that you understand that we shall not be liable to you in such events.

Authority; Compliance with Terms; Accuracy of Information

You represent and warrant to us that:

  • You have the right, authority, and capacity to agree to these Terms, to register for an Account, and to participate in our offer/ business for which you are registering;
  • You will comply with these Terms when participating in our offer/ business, and/or using our website;
  • All information you supply to us is complete, accurate and current (and knowingly submitting incomplete or inaccurate information, or failing to update and maintain current, complete and accurate information, may result, without limitation, in immediate termination of your Account and forfeiture of Earnings.

OUR INDEMNIFICATION OF US

Indemnification

You will, at your own cost and expense, indemnify and hold us and our directors, officers, employees and agents harmless from and against any and all claims, disputes, liabilities, judgments, settlements, actions, debts or rights of action, losses of whatever kind, and all costs and fees, including reasonable legal and attorneys' fees, arising out of or relating to:

  • Your breach of these Terms
  • Any use of your Account, the Site, the Software and the Services by any person including yourself
  • Your violation of Applicable Laws
  • The breach or non-fulfillment of any representation and warranty or covenant made by you in these Terms
  • Your provision of false, incomplete or misleading information (including, without limitation, citizenship, residency, nationality or email address); and/or
  • Your negligence, fraud or misconduct. Live Assured Limited reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Live Assured Limited. Live Assured Limited will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

Amendment and Modification

These Terms cannot be modified by you and may only be modified by us as provided.

This Agreement contains an Arbitration Provision. You agree and understand that if we cannot resolve a dispute through our operations Team, all disputes arising under these Terms shall be settled in binding Arbitration. You also agree and understand that entering into this agreement constitutes a waiver of your right to a trail and participation in a class action lawsuit.

OUR INDEMNIFICATION OF US

Notification of Disputes

In the event that you experience issues with the Services, please contact us first! We strive to improve our services and want to address your concerns without resorting to formal legal proceedings. Before filing a claim, you agree to try to resolve the dispute informally by contacting Live Assured Limited first at [support@liveassuredgroup.com]

Agreement to Arbitrate

You and Live Assured Limited agree to resolve any claims relating to these Terms (including any question regarding its existence, validity, termination, or any services or products provided and any representations made by us) through final and binding arbitration. You agree to first give us an opportunity to resolve any claims by contacting us as set forth in this Terms of Agreement. If we are not able to resolve your claims within 90 days of receiving the notice, you may seek relief through other legal means.

Arbitration Procedure

Any dispute, controversy, difference or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Nigerian Arbitration and Conciliation Act in force when the Notice of Arbitration is submitted. The law of this arbitration clause shall be Nigerian law. The seat of arbitration shall be Nigeria. The arbitration proceedings shall be conducted in English.

Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE IN ANY FORUM WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR WE WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. NO ARBITRATION OR PROCEEDING WILL BE COMBINED WITH ANOTHER WITHOUT THE PRIOR WRITTEN CONSENT OF ALL PARTIES TO ALL AFFECTED ARBITRATIONS OR PROCEEDINGS. IF THIS WAIVER IS FOUND TO BE ILLEGAL OR UNENFORCEABLE AS TO ALL OR SOME PARTS OF A DISPUTE, THEN IT WILL NOT APPLY TO SUCH PART. INSTEAD, THOSE PARTS SHALL BE SEVERED AND PROCEED IN A COURT OF LAW, WITH THE REMAINING PARTS PROCEEDING IN ARBITRATION.

Filing Requirement

Claims or disputes must be filed within 3 months. To the extent permitted by applicable law, any claim or dispute under these Terms must be filed within 3 months from the date of the cause of action. If a claim or dispute is not filed within one year, it shall be permanently barred.

Arbitration Notice

To begin an arbitration proceeding, you must send a hard copy letter requesting arbitration and describing your claims to Live Assured Limited's Headquarters. If we request arbitration against you, we will give you notice at the email address you have provided.

Controlling Law

These Terms, including any non-contractual obligations arising out of or in connection with it, shall be governed by and construed in accordance with the laws of Nigeria.

Equitable Relief

You agree that we would be irreparably damaged if these Terms were not specifically enforced. Therefore, in addition to any other remedy we may have at law, and notwithstanding our agreement to arbitrate disputes, we are entitled without bond, other security, or proof of damages, to appropriate equitable remedies with respect to your violation of these Terms in any court of competent jurisdiction.

MISCELLANEOUS

Entire Agreement

These Terms constitute the entire agreement between you and us pertaining to the subject matter hereof and supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. Our failure to require or enforce strict performance by you of any provision of these Terms or to exercise any right under them shall not be construed as a waiver or relinquishment of our right to assert or rely upon any such provision or right in that or any other instance. Section titles in these Terms are for reference only and have no legal effect.

Severability

The provisions of these Terms are intended to be severable. If for any reason any provision of these Terms shall be held invalid or unenforceable in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective to the extent of such determination of invalidity or un-enforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of the Terms, which shall continue to be in full force and effect.

These Terms cannot be modified by you and may only be modified by us as provided above.

Remedies

No right or remedy of ours shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys' fees and expenses.

Assignability

We may assign these Terms, in whole or in part, at any time without notice to you. You may not assign these Terms or transfer any rights to use the Services or Software.

Consent to Notice

You consent to our providing you notifications about the Services or information the law requires us to provide via email to the address that you specified when you created your Account. Notices emailed to you will be deemed given and received when the email is sent. If you do not consent to receive notices electronically, you must close your Account.

Successors and Assigns

These Terms are solely for your and our benefit, and not for the benefit of any other person, except for our successors and assigns.

A printed version of these Terms and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
